Unlike postal mailings, telephone campaigns must meet stringent legal requirements. All data must be run through the latest version of TPS (Telephone Preference Service) which is updated every 28 days. This now extends to companies through the CTPS (Corporate Telephone Preference Service) and the FPS (Fax Preference Service).

To avoid non-compliance with the law in this area you will need to screen your data prior to usage. It is your responsibility as the marketer to ensure this occurs, even if you have rented or leased the numbers from a third party, as the screening has a lifespan of only 28 days. Here are some brief details about each of the Preference Services:-

What is TPS?

The Telephone Preference Service (TPS) is a central opt out register whereby individuals can register their wish not to receive unsolicited sales and marketing telephone calls. It is a legal requirement that companies do not make such calls to numbers registered on the TPS.

The original legislation was introduced in May 1999. It has subsequently been updated and now the relevant legislation is the Privacy and Electronic (EC Directive) Regulations 2003

What is Corporate TPS?

The Corporate Telephone Preference Service (CTPS) is the central opt out register whereby corporate subscribers (see definition below) can register their wish not to receive unsolicited sales and marketing telephone calls to either all their organisation’s telephone numbers, or to certain numbers. It is a legal requirement that companies do not make such calls to numbers registered on the CTPS.

It takes 28 days for the registration to become fully effective.

What is the Fax Preference Service?

Under Government legislation introduced on 1 May 1999 it is unlawful to send an individual an unsolicited sales and marketing fax without prior permission. Businesses have the opportunity to register fax numbers on which they do not wish to receive direct marketing faxes.
